Terms & Conditions

By downloading, installing, or using the Navitruck application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these Terms, you must not use our App.

These Terms apply to all users of the App, including users who are contributors of content, information, and other materials or services on the App.

Subject to your compliance with these Terms, TekBH grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install a copy of the App on mobile devices that you own or control
• Use the App for your personal or commercial transportation needs
• Access and use the features and services we make available in the App

This license does not allow you to use the App on any device that you do not own or control.

You agree not to engage in any of the following prohibited activities:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove, circumvent, or modify any proprietary notices or labels
• Use the App for any illegal purpose or in violation of any laws
• Use the App to harass, abuse, or harm others
• Interfere with or disrupt the App or servers connected to the App
• Attempt to gain unauthorized access to the App or related systems

The App may allow you to save favorite locations, create routes, and store other data ("User Content").

You retain all rights to your User Content. By saving User Content in the App, you grant TekBH a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your User Content solely to provide and improve the App's services.

You are solely responsible for your User Content and the consequences of saving it. You represent that you own or have the necessary rights to all User Content you save.

Some features of the App require a paid subscription. By purchasing a subscription, you agree to:

• Pay all applicable fees for your subscription
• Provide accurate billing information
• Authorize us to charge your payment method for the subscription fees

Subscription fees are non-refundable except as required by law. We may change subscription fees at any time with notice.

The App may use third-party services that have their own Terms and Conditions. Your use of these third-party services is subject to their respective terms.

We use the following third-party services:

• Google Play Services
• RevenueCat (for subscription management)
• Map data providers
• Traffic data providers

We are not responsible for the content, policies, or practices of any third-party services.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, TEKBH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TEKBH, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR USE OR INABILITY TO USE THE APP
• ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN
• ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE APP
• ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE APP
• ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE APP

You agree to defend, indemnify, and hold harmless TekBH and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) resulting from or arising out of:

• Your use and access of the App
• Your violation of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claims that your User Content caused damage to a third party

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may simply discontinue using the App or uninstall it from your device.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

These Terms constitute the entire agreement between us regarding our App, and supersede and replace any prior agreements we might have had between us regarding the App.
